I have a roommate who is 5 days late on her rent,moving out behind my back?
I let a woman come in and live with me when she seperated from her husband. She has been living here for 3 months. Now she is 5 days late on the rent and I have heard through the grapevine that she is planning on moving out next week ( I know. I am a sucker) Is there anything I can do to make her pay me her half?!

if you didn’t collect a security deposit or a lease (or any other legally binding contract) you’re out of luck.
try keeping someone of hers as collateral. then let her try to take you to court.

leave her a note and keep a log of dates/times that you spoke to her or left her messages

and the above mentioned ideas of keeping or selling her stuff.. will only get you in jail or fined.. so dont do that either..
you made a stupid move out of a good hearted nature and got taken advantage of.. move on and learn from it!

tell her that you were good enough to let her stay in the first place and that you dont have all the money in the world and she should give you her share as its not fair otherwise

it will cost you more in time as well as costs. chalk it up to experience. ( have you actually asked her what is happening?)

You could try to take her to small claims court but I doubt you would win if she didn’t sign some sort of lease agreement to you. What a lousy friend, confront her on it and if she is moving out or she is refusing to pay rent, be like then get out asap. If she didn’t sign a lease, she has no rights but you can’t make her pay since you didn’t make her sign.

Before you jump into any conclusions, talk to her. Tell her she’s five days late, and you need the rent ASAP. If she does not pay and does indeed move out, keep her deposit. If you didn’t ask for a deposit, sue her.

I’m no lawyer, but without some form of written agreement, I’d say you’re just going to have to accept getting screwed on this one. Ahhhhhh, roommates how fun they can be.

depends on what the contract with the landlord is. Is she filed under the contract as a sublet? If she is a sublet, then it is your responsibility. But if she is actually mentioned under the lease as another resident, then you have a right to demand for it, or take her to court.

That’s life. Deal with it. It happens all the time, goodbye friendship. There is nothing legally you can do except log everything and try something very very unlikely to pan out, just frustrate and waste a lot of your time. Move on, it’s not worth one month of rent for all the time and effort you will put into getting it, trust me, been through it twice now.

I would do this the legal way…. TAKE HER TO SMALL CLAIMS COURT.
If you do this though, START (NOW) jotting notes on the things she’s done (moved in on this date, paid on this date, agreements, etc.) and the actions that she takes (moves out w/o paying, fights, etc). This will DEFINITELY help the judge see things from your perspective and order her to pay you back.

she has to tell you when she is moveing out and she still owes you the rent. I just took a course on contracts and i have learned that everything that the contract includes still fallows through untill it it formally cancled.

Yeah pack all her stuff up and kick her out today. i’m going to assume that she is paying at end of month not begining. so if she doesnt pay you lose out on the months she stayed. So first comfront her about it tell her shes late, and you heard she was going to move behind your back. tell her she has one day to pay. if she doesnt take her computer and kick her out your place.
